Most carports and patios in Brisbane need it. Here is what decides it, how long it takes, and why it is our problem rather than yours.

Three things decide it
Floor area is not one of them, which is the assumption behind most of the wrong answers on the internet.
Mean height
Not the ridge and not the gutter — the mean height of the structure. It is why a flyover patio gets looked at more closely than a skillion, and why a gable carport more often needs approval than a flat one.
Distance to the boundary
How close the structure sits to your fence line. You can build to within 500mm of a boundary with your neighbour's written agreement — and that agreement is not something you can arrange after the fact.
Overlays on the property
Character and flood are the two that come up most often around Brisbane. They attach to the land rather than to what you are building, which is why nobody can answer this question without your address.
The 500mm rule, in a picture
The setback — how close the structure sits to your fence line — is the constraint people run into most often, and the one that is hardest to picture from a sentence.
With your neighbour's written agreement, you can build to within500mm of the boundary. Without it, the required distance is greater.
It is worth having that conversation with your neighbour early. It is a much easier conversation before a structure is designed than after.

We check your address
Before quoting, we look at what sits over your property in the planning scheme. This is the step that decides whether the rest of the conversation is about a two-week job or a three-month one.
We prepare the drawings
Engineered to the span and the site, and drawn to what the council will actually assess rather than to a generic detail.
We lodge it and chase it
The application goes in under our name. If something needs negotiating — a setback, a height concession — we negotiate it. You do not chase a reference number.
A certifier signs it off
At completion the structure is inspected and certified. That signature is what makes it a legal structure rather than one you have to disclose and discount when you sell.
Approval usually runs 2–6 weeks, and it happens while materials are ordered.

The rules that decide approval are state-level and the same everywhere in South East Queensland. What changes between councils is the planning scheme layered on top — which overlays apply, how it is lodged, and what it costs.

What a web page cannot tell you
Whether your structure needs approval. Overlays are property-specific, and any site that gives you a definitive answer without your address is guessing — including the ones quoting a square-metre figure with great confidence.
What we will do is check it against your address before you have spent anything, and tell you plainly. If the answer is that you do not need approval, that is what we will say.
Common questions about council approval
Do I need council approval for a carport in Brisbane?
Usually, yes. What decides it is the mean height of the structure, how close it sits to your boundary, and whether an overlay applies to your property — not floor area alone. We prepare and lodge the application as part of the build, so it does not become something you have to manage.
What size carport can I build without a permit in QLD?
There is no single answer, and any site that gives you one without your address is guessing. Exemptions turn on the mean height of the structure, the setback from your boundary and the overlays sitting over your particular property. Some structures are exempt; most are not. Send us the address and we will tell you which side of the line you are on.
Do I need council approval for a patio?
Usually. The same three things decide it, which is why flyover patios — being taller — are looked at more closely than skillions. We handle the application as part of the build.
How long does council approval take?
2–6 weeks in the ordinary case. If the job needs a relaxation — a concession on setback or height — allow up to another four weeks on top.
How close to the boundary can I build?
You can build to within 500mm of a boundary with your neighbour's written agreement. Without that agreement the required setback is larger. Getting the neighbour's sign-off is something we will raise before you commit, not after.
What happens if I build without approval?
It becomes your problem at the point of sale, when an unapproved structure has to be disclosed — and a buyer either discounts for it or asks for it to be removed. Councils can also require retrospective approval or removal. It is a cheap thing to do properly and an expensive thing to unwind.
Do you handle the approval, or do I?
We do. Drawings, lodgement, dealing with the council and certification at the end are all part of the build. That is the point of using a licensed builder rather than buying a structure and finding someone to put it up.
